Off work on long term sick.....?
Honestly, it sounds like you have had a lot more to worry about then what your employer is doing however I will help you out with what I can. I have been a Labor Union President for most of my life and I have dealt with situations like yours quite often throughout my career. I can tell you that you won't have anything to worry about from your employer with your condition being as serious as it is. If you were out for stress, migraines, or even depression then there would be a very good chance that your employer may try to do something to terminate your employment. However, when you have cancer and serious health conditions such as these the employer will be very hesitant to say or do anything derogatory due to the fact that they will be concerned of a possible lawsuit. You have 12 weeks a year available to you through the Family Medical Leave Act (FMLA) that protects your job when you are out from a serious illness. It was ped and signed into law by President Bill Clinton in 1993 and it is supposed to be 12 weeks of unpaid time. However, if you have either a Union contract or individual contract that guarantees you retain your salary during sickness and injury, then the time is paid and is still covered under FMLA and cannot be charged against you by Federal Law. I hope this helps and I also hope that your condition is doing better. Good Luck!!!
